Article 1 - Scope of Application


All orders through our online shop are subject to the following general terms and conditions.

Article 2 - Contracting Parties, Conclusion of Contract


The purchase contract is concluded with America Today Germany GMBH.

By listing the products in the online shop, we are making a binding offer to conclude a contract on these items. You can place our products in the shopping cart first without obligation and amend your purchases at any time before submitting your binding order by using the amendment tools provided and explained in the ordering process. The contract is concluded by you clicking the order button and thereby accepting the offer of the goods in the shopping cart. Immediately after submitting the order, you will receive another confirmation by e-mail.

Article 3 - Contract Language, Contract Text Storage


  1. The language available for the conclusion of the contract is German.
  2. We will store the contract text and send you the contract data and other general terms and conditions by e-mail. You can view and download the general terms and conditions on this website at any time. You can view your past orders through our customer log-in.

Article 4 - Terms of Delivery


  1. The product prices shown do not include shipping costs. You will find more details about the price of shipping with the offers.
  2. Items are only available for shipment. Unfortunately it is not possible for you to collect the item in person.
  3. We do not deliver to Packstations.

Article 5 - Payment


    In our shop, in general Ogone offers you the following payment methods.
  1. Credit card Credit card When submitting your order, you transmit your credit card details to us at the same time. Immediately after the order, once you have been verified as the legitimate cardholder, we ask your credit card company to run the payment transaction. The payment transaction is performed automatically by the credit card company and your card is charged.
  2. PayPalYou will be redirected to the website of the online provider PayPal during the ordering process. In order to be able to pay the invoice amount by PayPal, you either must already be registered there or must register, then verify your access details, and confirm the payment instruction to us. After submitting the order in the shop, we will ask PayPal to run the payment transaction. You will receive further instructions during the ordering process. The payment transaction will then be performed by PayPal immediately after that.
  3. SOFORT Transfer After submitting the order, you will be redirected to the website of the online provider SOFORT Transfer. In order to be able to pay the invoice amount by SOFORT Transfer, you must have an online banking account with a PIN/TAN procedure approved for participation in SOFORT Transfer, verify yourself accordingly, and confirm the payment instruction to us. You will receive further instructions during the ordering process. The payment transaction will be performed by SOFORT Transfer immediately after that and your account will be charged.
  4. Giropay After submitting the order, you will be redirected to your bank’s website. In order to be able to pay the invoice amount by Giropay, you must have an online banking account with a PIN/TAN procedure approved for participation in Giropay, verify yourself accordingly, and confirm the payment instruction to us. You will receive further instructions during the ordering process. The payment transaction will be performed immediately after that and your account will be charged.
  5. Purchase on Klarna account In cooperation with Klarna AB ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer purchase on account as a payment option. For a purchase on account with Klarna, you will always receive the item first and then you always have a payment term of 14 days. The payment will be made to Klarna. Please note that purchase on account is only available for consumers. The full terms and conditions for purchase on account for deliveries to Germany can be found here.The online shop applies a charge of EUR 0 per order for purchase on account. Klarna will check and assess your details and, if there is legitimate interest and reason, will exchange data with other companies and credit reporting agencies. Your personal details will be handled in accordance with the applicable data protection regulations and in line with the terms of Klarna’s Data Protection Regulations for Germany

    In order to offer you Klarna’s payment methods, we might in the checkout pass your personal data in the form of contact and order details to Klarna, in order for Klarna to assess whether you qualify for their payment methods and to tailor those payment methods for you. Your personal data transferred is processed in line with Klarna’s own privacy notice.

Article 6 - Retention of Title


The item remains fully our property until payment is complete.

Article 7 - Warranty and Guarantees


  1. Unless hereinafter explicitly agreed otherwise, the statutory warranty rights apply.The limitation period for warranty claims for used items is one year after delivery of the item. The above restrictions and shortened deadlines are not applicable in the case of claims due to damage caused by us, our contractors or subcontractors
    • in the case of injury to life, body, or health,
    • in the case of intentional or grossly negligent breach of duty or malice,
    • in the case of violation of essential contractual obligations which must be performed in the first place for the proper execution of the contract and which the contracting partner can regularly rely on being performed (cardinal obligations)
    • as part of a guarantee pledge as agreed, or
    • to the extent that the scope of application of the Product Liability Act is effective.
